Welcome to the first episode of the podcast Your Voice in Law, created in collaboration with Fundacja Portugalia, especially for Portuguese citizens living in Poland.

My name is Ernestyna, I’m a Polish lawyer, and today we’re going to talk about a topic many of you have already encountered or considered when moving to Poland: starting your own business.

🇪🇺 Freedom to Do Business in the European Union

With the establishment of the European Union came the freedom to carry out economic, scientific, and commercial activities. This means that EU citizens must be treated equally in all member states.

 

This freedom includes:

  • Choosing your place of work
  • Choosing your place of residence
  • Carrying out professional activities
  • Access to education

 

📋 How does it work in practice for Portuguese citizens?

  • No special permits are required, except for regulated activities.
  • Portuguese citizens can start and run businesses in Poland under the same conditions as Polish citizens.

 

Some activities require:

  • Specific licenses
  • Professional qualifications
  • Official examinations
  • Registration with relevant professional bodies

 

🧾 Economic Activity – Basic Rules

An economic activity is:

  • Organized
  • Profit-oriented
  • Carried out in one’s own name and on a continuous basis

 

For this type of activity, registration is required in the:

Central Registration and Information on Business (CEIDG)

 

However, not all activities require registration:

  • If the activity is small-scale (non-registered business)
  • Provided that monthly income does not exceed the minimum wage

 

Income limits for 2024:

  • January–June: 3,181.50 zł
  • From July: 3,225.00 zł

 

❌ Exceptions to Registration Requirements

Registration is not required for:

  • Agritourism activities by farmers
  • Homemade wine production
  • Direct sale of agricultural products
