Introduction
Welcome to another episode of Your Voice in Law, a podcast created in partnership with Fundacja Portugalia for the Portuguese community in Poland.
In this episode, we explain how to get legally married (civil marriage) in Poland – all the required steps and legal conditions.
1. Prepare the Required Documents
Couples must submit the following to the Civil Registry Office:
- Original birth certificate with certified translation
- Document confirming eligibility to marry under Portuguese law
- Valid passport or national ID
2. Pay the Fees
- Marriage certificate issuance: 84 PLN
- Urgent processing (e.g. pregnancy, illness): 39 PLN
- Off-site wedding ceremony (on request): fee depends on the location
3. Submit a Declaration at the Registry Office
At least one month before the ceremony, both partners must:
- Declare there are no legal obstacles to the marriage
- Choose which surname(s) to use after marriage
🗓️ The declaration is valid for 6 months. In exceptional cases, the registry office may allow an earlier date.
4. Legal Impediments
The following prevent legal marriage under Polish law:
- Underage
- Incapacity or serious mental illness
- Family relationship (blood/adoption)
- Already married
5. The Ceremony & Name Choice
During the ceremony:
- Both parties sign the marriage certificate
- Declare the surname they’ll use
Options:
- One shared surname
- Keep current surnames
- Combine surnames
If no decision is made, both partners keep their current names.
