In this episode of the podcast A Tua Voz em Direito, we explore in detail the legal framework of police identification in Poland, a topic relevant to all citizens, particularly the Portuguese community living in the country.

 

Throughout the episode, we explain the legal grounds that allow authorities to carry out the identification of an individual, namely under the Police Act and the applicable regulations. We also address the obligations placed on police officers during this procedure, including the duty to identify themselves (stating their rank, first name and surname), to explain the reason for the action, and to indicate the legal basis when requested.

We also highlight the importance of transparency and the protection of civil rights in this context, as well as the citizen’s right to question the legitimacy of the identification. Based on relevant case law, we analyse situations in which the absence of a legal basis may allow a person to refuse to provide their details without legal consequences.

The episode also addresses the duties of citizens and the potential legal consequences of failing to comply with lawful orders from the authorities, including sanctions provided for under the Code of Offences.
